1: Introduction

This privacy policy aims to provide you with information about how the Company handles your personal information as a contact person at a customer company or potential customer company for any PWS company (Company). The Privacy Policy also describes your rights to us and how you can assert your rights. The customer companies with whom the Company has a contractual relationship or is to enter into a contractual relationship is below referred to as “Customers”. The companies that the Company contacts without having an existing or near-standing customer relationship are referred to as “Potential Customers.”

2: Who is the data controller?

The respective PWS company is the responsible legal person for the processing of the personal data collected in relation to the Customers and Potential Customers contacts.

3: Types of personal data to be processed

3.1 Customers.
The Company processes the following personal information about Customer’s contact persons. (a) Name (b) Telephone number (c) Fax number (d) Email address. If the customer is your own company, we may also obtain the following information. (a) Company organization number (which is also your social security number) (b) Credit information for your individual company. The processing of the above personal data is necessary for the Company to be able to fulfill the agreement that the Company has with the Customer. In the case that these data can’t be processed, the agreement with the Customer can’t be fulfilled. The data is collected from yourself and / or the Customer you represent. The Company also saves customers’ purchase history, i.e. description of purchased product, number, date and price.

3.2 Potential Customers.
The Company processes the name, contact details and position of Potential Customers. The data is collected from contacts with Potential Customers, for example by mail, phone calls, trade fairs and the like.

4: Objective, legal basis and time of storage

4.1 Customers

4.1.1 Customer Administration.
The name and contact details are processed in order for the Company to fulfill the purchase, deliver the goods to the Customer, and otherwise administer the Customer’s orders and provide services to the Customer after the purchase, as well as to exercise their rights and obligations under the agreement with the Customer. If the Customer is not an individual company, the treatment is conducted with an interest balance as a legal basis, where the Company’s legitimate interest is to be able to fulfill the agreement with the Customer and provide the Customer with good service. If the Customer is a sole proprietor, the legal basis for processing is that it is necessary for the Company to be able to fulfill the agreement with the Customer.

4.1.2 Returns, Warranty Claims and Product Liabilities.
The Company saves information about Customer’s purchase history, as well as any correspondence and documentation regarding the products purchased by the Customer. Such documentation may include the name and other contact details of the contact person. The Company saves such documentation as long, and to the extent necessary, as to enable the Company to provide Customer with qualified after-sales service and to handle any complaints, warranty claims and requirements under the Product Liability Act. The data is saved for these purposes based on a balance of interest.

4.1.3 Direct marketing.
The Company may also handle your e-mail address for direct marketing. The marketing consists of the Company sending via e-mail newsletters and offers of goods / services that we consider to be relevant to your professional activity. For contacts with Customer companies, newsletters and offers can be sent by e-mail for up to five years after the Customer’s latest purchase. Newsletters and promotional e-mails are sent only on the condition that you have not opposed such promotion, and you may choose to unsubscribe at any time from our newsletters and marketing tips. To unsubscribe, please contact the Company at info@pwsab.se or info@pwsas.dk or use the unsubscribe link contained in each newsletter / e-mail. The marketing takes place with a balance of interests as a legal basis, where the Company’s legitimate interest is to market its products.

4.1.4 Other.
In addition to the above, the Company may process your personal data if it is necessary to comply with a legal obligation requiring treatment under applicable law or for the Company to determine, enforce or defend legal claims.

4.2 Potential Customers.
The Company uses the contact data for marketing purposes based on a balance of interest. The marketing is made up of newsletters and offers that we consider to be relevant to you in your professional practice. Newsletters and promotional e-mails are sent only on the condition that you have not opposed such promotion, and you may choose to unsubscribe at any time from our newsletters and marketing tips. To unsubscribe, please send an e-mail to the Company at info@pwsab.se or info@pwsas.dk or use the unsubscribe link contained in each newsletter / e-mail. Your information is saved as long as the Company needs the information for the promotional campaign(s) for which the data was collected, provided that you have not previously opposed our marketing. The marketing takes place with a balance of interest as a legal basis, where the Company’s legitimate interest is to market its products.

5: To whom can we transfer your information?

The Company may transfer your personal information to web site administrators, CRM system providers and the like. These recipients are only entitled to process your personal information on behalf of the Company in the course of performing a service for the Company, such as to deliver an ordered item to the Customer. The Company takes all reasonable legal, technical and organizational measures to ensure that your data is handled securely and with an adequate level of protection upon transfer to or sharing with such selected third parties. The Company may also provide your personal information to authorities, such as Tax Agency, if we are required to do so by law. In the event of all or part of the Company’s business is divested, the Company may transfer your personal information to a potential buyer of the business.

6: Transfer of personal data under EU / EEA?

Your personal information will mainly be processed within the EU / EEA, but may also be transferred to non-EU / EEA countries. The company has taken appropriate safeguards to protect your personal data by the fact that the recipient of personal data has signed an agreement containing certain standard agreement clauses that have been approved by the EU Commission. 7: Your rights

You are entitled to receive an answer as to whether the Company processes personal data about you. If so, you are entitled to information about what personal data is processed, the purpose of the processing, what external recipients are taking part in your personal data and how long we save your personal data. (b) Data portability right (only individual companies). If you are a customer through an individual company, you are entitled to request a copy of the personal data that you have provided to the Company in a structured, widely used and machine-readable format. You also have the right to request that the Company transfer these personal data to another person responsible for personal data. The right to data portability applies to personal data processed by automated route, based on your consent or on an agreement where you are a party. (c) Correction of incorrect information. You are entitled to request that the Company correct incorrect or incomplete information about yourself. (d) Deletion of certain tasks. You are entitled to request that the Company delete your personal information under certain conditions, such as the personal data are no longer necessary for the purpose we collected the personal data for. (e) Right to object to the Company’s processing of personal data. You are entitled to object to the Company’s processing of your personal information under certain conditions. (f) Right to object to direct marketing. You are entitled at any time to object to the Company processing your personal data for direct marketing. If you object to such treatment, the Company shall without undue delay terminate all direct marketing to you. (g) Right to limit processing your personal data. You may request a limitation of the Company’s processing of your personal information in some cases. For example, if you have contested that your personal information is correct, you may request a limitation of treatment for a time that allows the Company to check if your personal information is correct. (h) Complaints. If you have complaints about the Company’s processing of your personal data, you are entitled to file such complaints with the Data Protection Authority.
